Conditions for obtaining permanent residence

Not just anyone can apply for a permanent residence visa. To obtain a permanent residence visa, you must meet the conditions set forth in the "Guidelines for Permanent Residence Permits.

Immigration Law Conditions

Good conduct
The applicant must comply with the law and live a socially acceptable life as a resident in his/her daily life.
Have sufficient assets or skills to earn an independent living
The applicant must not be a burden on the public in his/her daily life and must be expected to have a stable life in the future in view of his/her assets or skills, etc.
(2) The permanent residence of the person is deemed to be in the best interest of Japan.
(a) In principle, the applicant must have continuously resided in Japan for 10 years or more. However, during this period, the foreign national must have a work qualification (excluding "technical internship" and "specified technical skill 1") or a residence status (2) The applicant must have continuously resided in Japan for at least 5 years with a work status (excluding "Technical Intern Training" and "Specified Trade Skills 1") or residence status.

(a) The applicant must not have been fined or imprisoned. (b) The applicant has properly fulfilled his/her public obligations (tax payment, payment of premiums for public pension and public medical insurance, and notification and other obligations stipulated in the Immigration Control and Refugee Recognition Act).

c. The applicant must be residing for the maximum period of stay stipulated in Appended Table 2 of the Enforcement Regulations of the Immigration Control and Refugee Recognition Act with regard to the status of residence he/she currently possesses.

(d) There is no risk of harm from the standpoint of public health.

*However, in the case of a spouse or child of a Japanese national, permanent resident, or special permanent resident, neither (1) nor (2) shall be required to be met. In addition, in the case of a person who has refugee status, he/she is not required to conform to (2).

The examination for permanent residence includes the alien's own annual income and assets, occupation, and income of the alien's spouse. The term "public burden" refers to public assistance. The main focus is on whether the foreigner will be able to live without problems in the future.

(2) The permanent residence of the person is deemed to be in the best interest of Japan.

There are several items in this condition, all of which must be met. 

As a general rule, the applicant must have been continuously residing in Japan for at least 10 years.

You must have resided in Japan continuously for at least 10 years, of which at least 5 years must have been spent in Japan with either a work or residence status. Even if you have been in Japan for more than 10 years, if you have been in Japan for more than 6 years under the status of "foreign student," you will not be admitted.

Proper fulfillment of public obligations.

Public obligations refer to obligations such as tax payment, payment of pension premiums and national health insurance premiums, and notification required by the Immigration Control Act. At the time of application, documents proving tax payment or payment must be submitted. In addition, it is a necessary condition that the applicant has not been fined or imprisoned.

Must have the longest period of stay in the current status of residence

Most of the periods of stay stipulated in the status of residence extend the maximum period of stay according to the renewal of the status of residence. In most cases, the maximum period of stay is five years. If the period of stay under your current status of residence is 5 years, it can be considered the longest period of stay.

Not likely to be harmful from a public health standpoint

Simply put, the question is, "Are you infected with a potentially harmful infectious disease?" If you have had an infectious disease in the past, you must prove that it is not likely to become harmful in the future. Special Exceptions to the Conditions for Acquiring Permanent Resident Status

Exemption from the condition of 10 years of residency in principle

For spouses of Japanese nationals, permanent residents and special permanent residents
The marriage must have lasted for at least three years and the applicant must have resided in Japan for at least one year.
Their biological children or specially adopted children (not including regular adopted children) must have been continuously residing in Japan for at least one year.
For permanent residents
Must have been continuously residing in Japan for at least 5 years with "Permanent Resident" status.
For persons who have been granted refugee status
Must have resided in Japan continuously for at least 5 years after certification.
In the case of a person who is recognized as having made a contribution to Japan
Must have resided in Japan continuously for at least three to five years, depending on the nature of the activity.
If any of the following apply to you as an advanced professional
Must be recognized as having at least 70 points for 3 years as a highly qualified professional, based on the point in time 3 years prior to the date of application for permanent residence.

Must be recognized as having at least 80 points for one year as an advanced professional, based on the point in time one year prior to the date of application for permanent residence.
